The ruling regarding kidnapping and executing innocent non-muslims
Question:
This one says: “Unfortunately, some people are being taken away by extreme emotions, and support what is being done by some groups which ascribe themselves to Islam; from grabbing and seizing of hostages and non-muslim prisoners, blindfolding them, tying them up and subsequently cutting their throats in front of the cameras, which has appeared on some television screens. And they say that this act is an intimidation of the enemy and an answer to what they do with the Muslims in the prisons. I hope, oh shaykh, for a clarification of what the Prophet (صلى الله عليه و سلم) did with the prisoners of Badr, in order that the benefit may spread and as to respond to them.”
Answer:
“Allah, the Majestic and Most High, says:
{...and no bearer of burdens shall bear the burden of another.} [Surah Al-An’am 6:164]
If the disbelievers behave badly and enmity occurs from them, then you are not allowed to grab the musta’manun[1] and the mu’ahadun[2] who are in the Muslim countries, and to capture and intimidate them.
This is not permissible; this is treachery! And the one who is with you, didn’t do anything. So how can you take him to account for the action of another?
{...and no bearer of burdens shall bear the burden of another.} [Surah Al-An’am 6:164]
This is from one angle.
And from the second angle that this is treachery of the agreement, because these are mu’ahadun, they enjoy protection, security and safety. It is therefore not allowed to take them hostage and it is not allowed to kidnap them. Rather they are to be guaranteed safety until they return back to their countries. As long as they are in Muslim countries, then what is due to them is the same as what is due to the Muslims by way of rights and obligations. Their right must be carried out!
This behaviour does not belong to Islam. This belongs either to ignorant people who do not know Islam, or to the people of evil who want to distort Islam by way of these actions. And Islam is innocent of them (these actions)!”

السؤال:هذا يقول: بعض الناس للأسف تأخذهم الحماسة ويؤيدون ما يفعله بعض الجماعات المنسوبة للإسلام من أخذ واختطاف للرهائن والأسرى الأجانب وتعصيب أعينهم وتربيطهم، ثُمَّ نحرهم أمام الكاميرات والتي ظهرت على بعض الشاشات في التلفزة، ويقولون: أن هذا الفعل ترهيب للعدو ورد على ما يفعلون في المسلمين في السجون، أرجو يا شيخ إيضاح ما فعل الرسول صلى الله عليه وسلم بأسرى بدر لتعم الفائدة وللرد على هؤلاء؟
الجواب: هذا الله جلَّ وعلا يقول: (وَلا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى) [الأنعام:١٦٤] إذا كان الكفَّار أساءوا وحصل منهم اعتداء فلا يجوز أنك تأخذ المستأمنين والمعاهدين الذين في بلاد المسلمين تأسرهم وترهبهم هذا لا يجوز، هذا خيانة، وهذا الذي عندك ما فعل شيء، بل كيف تأخذه بفعل غيره (وَلا تَزِرُ وَازِرَةٌ وِزْرَ أُخْرَى) هذا من ناحية، الناحية الثانية: أن هذا خيانة للعهد؛ لأن هؤلاء معاهدون لهم ذمة ولهم عهد ولهم أمان، فلا يجوز أخذهم رهائن ولا يجوز اختطافهم؛ بل يجب أن يؤمَّنوا حتى يرجعوا إلى بلادهم، ما داموا في بلاد المسلمين لهم ما للمسلمين وعليهم ما على المسلمين، فيجب الوفاء في حقهم، فهذه التصرفات ليست من الإسلام؛ هذه إمَّا من جهال لا يعرفون الإسلام، وإمَّا من أهل الشر يريدون أن يشوهوا الإسلام بهذه الأعمال، والإسلام منها بريء
