Giving away a gift to someone else
Question:
“When a person gives a gift and makes a condition that he (the receiver) may not sell this gift; is this condition correct and should he fulfil it?”
Answer:
“When a person has taken receipt of the gift, then it falls under his belongings. And when it falls under his belongings, than he may do with it what he wants. He may gift it to someone else, sell it or use it. The decision is up to him.
With regards to making conditions, like not selling and not acting freely, then without doubt, these are conditions that are not mentioned in Allah’s Book.
But when you give something away and it leaves your hands and it (subsequently becomes) forbidden for you to reclaim it, then this gift has moved from your belongings to the belongings of the receiver. So the receiver may do with it what he wants.”
