Seeking help from the disbelievers out of necessity
Question:
“Nowadays there are some students of knowledge who say that al-isti’aanah (seeking help) from the mushrikeen (idol worshippers) falls under al-muwalaat[1] and that this is disbelief. Because seeking help from the disbeliever is regarded as disbelief. And is this matter regarded as a matter of ijtihaad[2] or is this a matter of walaa (love) and baraa (hate)[3]? We would like a clarification.”
Answer:
“These words are words which originate from an ignoramus who does not know what he is saying! The seeking of help (from disbelievers), when there is a need for it and out of necessity is not muwalaat. This falls under relations/dealings. Just like we buy weapons and goods from them. This falls under the exchange of services and not under al-muwalaat. Al-muwalaat is to have love.
We seek their help despite that we do not love them. Only out of necessity. And likewise (they help us) for their own interests because they get something in return. They do not help us for free. They get something in return. So this falls under relations/dealings, oh brother, and not under al-muwalaat!
It is upon the Muslim to fear Allah and not to speak without knowledge, nor to give fatwa without knowledge, nor should he go against the people of knowledge!
Furthermore, this is not a matter of ijtihaad because of the presence of proofs. And since there are proofs, then this is something which is textually established. It is not a matter of ijtihaad in the meaning of al-istinbaat[4]! Rather it is a ruling with proof, like we have already mentioned to you.
But like I said, it is upon the ignoramus to be quiet. Especially regarding these important matters. He should not step in with lies and ignorance and to judge with disbelief (kufr). And so you see him judge with disbelief. We take refuge with Allah! And this turns back upon himself and the danger is with him! It is therefore upon a person not to step into these matters with falsehood, and to speak about Allah without knowledge and accuse the scholars. Yes.”

السائل: هذا سائل يقول يوجد من بعض طلبة العلم اليوم من يقولون ان الإستعانة بالمشركين تعتبر من موالاتهم وأن ذلك كفر لأن الإستعانة بالكافر تعتبر كفر، فهل هذه المسألة هل تعتبر من المسائل الإجتهادية ؟ أم هي من المسائل التي يعقد عليها الولاء والبراء نرجو التوضيح ؟
الجواب: هذا الكلام كلام جاهل لا يدري ما يقول، ليس الإستعانة بهم عند الحاجة والضرورة من الموالاة هذا من التعامل معهم، مثل ما نشتري منهم السلاح، ومثل ما نشتري منهم البضائع والمنتوجات، هذا من تبادل المصالح وليس هو من الموالاة، الموالاة هي المحبة، فنحن نستعين بهم وإن كنا لا نحبهم، من أجل الضرورة فقط ومن أجل مصلحتهم هم لأنهم يأخذون منا مقابل ما هم يساعدوننا مجاني، يأخذون منا مقابل، فهذا من التعامل يا أخي وليس من الموالاة
وعلى المسلم أنه يتقي الله ولا يقول بغير علم ولا يفتي بغير علم ولا يخالف أهل العلم وليس هذا من الإجتهاد هذا فيه أدلة ما دام فيه أدلة فهذا منصوص عليه ليس هو من الإجتهاد الذي هو الإستنباط فقط إنما هو قول بدليل كما ذكرنا لكم، لكن كما ذكرت على الجاهل أن يسكت لا سيما في هذه الأمور المهمة ولا يدخل فيها بتخرص أو بجهل ويحكم بالكفر قد رأيتم من حكم بالكفر والعياذ بالله وهذا يرجع إليه هو والخطر عليه هو فلا يجوز للإنسان أن يتخرص في هذه المسائل ويقول على الله بغير علم ويتهم العلماء. نعم
